Évaluation du code minier révisé de la République Démocratique du Congo / Assessment of the Revised Mining Code of the Democratic Republic of Congo

This article examines the revision of the Mining Code of the Democratic Republic of Congo (DRC) and its impact on the extractive industry and the national economy. Addressing challenges related to governance and profitability in the mining sector, the 2018 reform aimed to enhance wealth redistribution while strengthening state control. The study highlights key changes, including increased mining royalties, taxation of superprofits, and the reduction of tax incentives for foreign companies. However, these reforms have sparked tensions with investors, who argue that they reduce the country’s attractiveness. Compared to other African nations such as Zambia and Ghana, the DRC seeks a balance between economic sovereignty and international competitiveness. The analysis reveals that, despite abundant resources, the country struggles to translate its mining potential into tangible socio-economic development. Finally, the article proposes recommendations to optimize mining governance, emphasizing the need for greater transparency, a more stable legal framework, and equitable redistribution of revenues generated by the sector.
